A lot has changed in the property market since 1988 and one thing that has changed is the difference between the actual property’s market value and the value used to calculate each property. Some owners may find their property’s taxable value has gone up as much as 5 times the original amount. The Marbella Town Hall has also passed new property zoning laws which will also affect the value of many properties in the area.

What can you do?

If you have recently received this letter and don’t agree with the new value assigned to your property, you only have one month from that date to file a complaint. This must be filed with either the regional Economic-Administrative Court or the national Tax Office.

Be sure to check for any mistakes in the evaluation such as the size of the plot of land, buildings which may have been included which you don’t own, or your property being over evaluated much more than the market value. The Spanish Land Registry website is there to provide reliable information and legal safety to property buyers in Spain. Until recently this year, all the information on there has been in Spanish so unless you speak the language it’s not been much help. Now though, the Spanish Land Registry is providing information in English as well.

This is great news for prospective property buyers as there will be less risk of being scammed. Fraudsters can no longer make false claims about ownership as buyers can now easily check it online themselves.

Unfortunately, the worry is that now the information is being given in English, some buyers may try to cut corners by doing the legal work themselves. Hard up sellers will tell buyers they no longer need a lawyer because you can view the details in English and they will provide a notary. We would not recommend buying a property in any country without legal representation.
